Dear Sir,
“No government official — including the President — is above the law,”
You have blocked me on Twitter for well over a year now. Accordingly you have violated my First Amendment rights. That is the unanimous decision on appeal from the U.S. Court of Appeals for the 2nd Circuit.
Today this Federal Appeals Court upheld that you, Donald J. Trump, President of the United States of America, my country of citizenship, cannot block your critics from the Twitter feed you regularly use to communicate with the public, as President of the United States.
The decision upholds an earlier ruling that you, Donald Trump violated First Amendment rights when you blocked individual users critical of you or your policies. “The First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise open online dialogue because they expressed views with which the official disagrees,” Judge Barrington D. Parker.
I note that the original ruling rejects your administration arguments that the First Amendment does not apply to YOU in this case under your now negated assertion that you were acting as a private individual. In a 75-page decision, Judge Naomi Buchwald said Trump, as a federal official, is not exempt from constitutional obligations to refrain from “viewpoint discrimination.” “No government official — including the President — is above the law,” Buchwald for the U.S. District Court for the Southern District of New York. This has now been upheld.
Accordingly I am putting you on notice to unblock my Twitter account, @MelanieNathan1 within 7 days hereof, or I will be forced to take further legal action to secure my First Amendment rights as an American citizen.
I sign this as a citizen in solidarity with Caged Children and Separated Families,
Melanie Nathan
